NOTICE OF SUBSTITUTE TRUSTEE’S

In execution of a deed of trust, from LISA B. EDMONDS, dated July 30, 1998, in the original principal amount of $56,649.61, recorded in the Clerk’s Office of the County of Chesterfield, Virginia, in Deed Book 3342, at page 548 (Seth E. COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS

April 24, 2013 Chesterfield County Community Development Block Grant Office P.O. Box 40 Chesterfield, Virginia 23832 (804) 748-1548 These notices shall satisfy two separate but related procedural notification requirements for the activities to be undertaken by the County of Chesterfield, Virginia.

REQUEST FOR THE RELEASE OF FUNDS

On or about May 10, 2013, the County of Chesterfield, Virginia will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of funds under the Community Development Block Grant Program, authorized by Title I of the Housing and Community Development Act of 1974, as amended, for the purpose of: Project Title: Huntingcreek Hills Drainage Improvements Location: North boundary of Huntingcreek Hills subdivision from Huntingcreek Drive to Watchaven Lane Purpose of Project: Installation of infrastructure to improve drainage and reduce water ponding after rain events Estimated Cost: $136,030 CDBG funds Project Title: Public Sewer Service 2400 Block Sherbourne Road Location: 2400 Block of Sherbourne Road Purpose of Project: Installation of public sewer system Estimated Cost: $200,000 CDBG funds

FINDING OF NO SIGNIFICANT IMPACT

The Chesterfield County has determined that the above listed projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) for the above listed projects on file at the Budget and Management Office, Room 401, Lane B. Ramsey Administration Building, 9901 Lori Road, Chesterfield, VA and may be examined or copied, upon request, weekdays 8:30 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency disagreeing with these determinations or wishing to comment on the projects may submit written comments to the Chesterfield County Budget and Management Office. All comments received by May 9, 2013 will be considered by the Chesterfield County prior to authorizing submission of a request for release of funds and environmental certification approval. Commentors should specify which aspect of the Combined Notice they are addressing. RELEASE OF FUNDS Chesterfield County certifies to HUD that James J. L. Stegmaier, in his capacity as County Administrator, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Chesterfield County to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the Chesterfield County certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Chesterfield County; (b) the Chesterfield County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD, 600 E. Broad Street, Richmond, VA 23219-1800, ATTENTION: Mr. Ronnie J. Legette, Sr., Director, CPD Division. Potential objectors should contact HUD at (804) 822-4833 to verify the actual last day of the objection period.
